
Spanish Law 2/2023: Safe Internal Reporting Channels
This course explains the obligations, protections and procedures established under Spain's Law 2/2023 for the protection of persons who report regulatory infringements and corruption. Designed for all staff, it builds awareness of how to use internal reporting channels safely and confidently.
Spain's Law 2/2023, of 20 February 2023, on the protection of persons who report regulatory infringements and the fight against corruption, transposes Directive (EU) 2019/1937 into Spanish law. It establishes a comprehensive framework requiring organisations of 50 or more employees, as well as public sector bodies of any size, to implement secure internal reporting channels and to protect whistleblowers from retaliation. This course forms the 'All Staff' component of a two-part compliance programme for organisations operating in Spain.
Throughout this course you will learn what Law 2/2023 covers, which behaviours and infringements can be reported, how to use your organisation's internal reporting channel, and what legal protections exist for you if you make a report in good faith. You will also understand the role of Spain's Independent Authority for the Protection of Informants (A.A.I.), the external reporting options available, and what your organisation is obliged to do once a report is received.
