Operating Compliant Internal Reporting Channels under Kenyan Law

Operating Compliant Internal Reporting Channels under Kenyan Law

Designed for managers and compliance teams in Kenya, this course provides a comprehensive, practical guide to establishing, operating and maintaining internal whistleblowing channels that meet obligations under Kenyan law, including the Bribery Act 2016 and the Anti-Corruption and Economic Crimes Act.

This course is the second in a two-part series on whistleblowing compliance for Kenyan organisations. Where the first course introduces all staff to their rights and responsibilities as reporters, this course equips managers and compliance professionals with the detailed legal knowledge, procedural frameworks and governance skills needed to design, implement and oversee internal reporting channels that are fully compliant with Kenyan law.

Participants will examine the substantive requirements of the Bribery Act 2016, the Anti-Corruption and Economic Crimes Act (ACECA) and related regulations, explore the roles of key regulators including the Ethics and Anti-Corruption Commission (EACC) and sector-specific bodies, and learn how to manage reports sensitively while protecting the confidentiality and safety of whistleblowers. Practical guidance is provided on triage, investigation, record-keeping, non-retaliation policies and board-level reporting.

By the end of this course, managers and compliance teams will be able to articulate the legal obligations that apply to their organisation, build a reporting culture grounded in trust and accountability, and respond to disclosures in a manner that is fair, lawful and consistent with international best practice for anti-corruption compliance.
