Operating Compliant Crime Prevention Models under Chilean Law

Operating Compliant Crime Prevention Models under Chilean Law

A specialist course for managers and compliance teams covering the design, implementation and ongoing operation of Crime Prevention Models under Law 20.393 and the Economic Crimes Law (Law 21.595), including whistleblowing obligations, regulatory expectations and governance best practice in Chile.

This course forms the second part of a two-course Chilean compliance series and is designed specifically for managers, compliance officers and legal counsel who carry direct responsibility for building and maintaining effective Crime Prevention Models (Modelos de Prevención de Delitos, or MPDs) within their organisations. Drawing on the foundational requirements of Law 20.393 on corporate criminal liability and the landmark Economic Crimes Law (Law 21.595) enacted in 2023, the course provides a rigorous, practitioner-focused guide to translating statutory obligations into operational compliance programmes that withstand regulatory scrutiny.

Participants will explore the expanded catalogue of predicate offences introduced by Law 21.595, the enhanced duties placed on senior management, and the critical role of the Crime Prevention Officer (Encargado de Prevención). The course also examines the architecture of effective internal reporting channels, the protections afforded to whistleblowers, and the investigative and disciplinary procedures that organisations must have in place to demonstrate genuine commitment to compliance rather than mere formal adherence.

By the end of this course, managers and compliance professionals will be equipped to audit existing MPDs against current legal standards, identify gaps created by Law 21.595's reforms, advise their organisations on proportionate and effective controls, and foster a speak-up culture that supports early detection and remediation of misconduct. Practical checklists, scenario analysis and assessment questions are integrated throughout to reinforce learning and support application in real organisational contexts.
