
Investigating Infringements & Eliminating Retaliation in Spain
Equip managers and compliance teams with the knowledge and practical tools to conduct lawful, effective investigations under Spain's Law 2/2023 on the Protection of Informants against Corruption, and to build a workplace culture that actively prevents retaliation.
This course is designed for managers and compliance professionals operating within organisations subject to Spain's whistleblowing framework. Drawing directly on Law 2/2023, of 20 February, on the Protection of Persons who Report Regulatory Infringements and on the Fight against Corruption (Ley 2/2023, de 20 de febrero, reguladora de la protección de las personas que informen sobre infracciones normativas y de lucha contra la corrupción), the course provides a rigorous examination of investigation procedures, channel obligations, confidentiality requirements, and the absolute prohibition on retaliation against informants.
As the second course in a two-course set for Spain, this programme builds on foundational awareness and moves into operational depth. Participants will explore how to design and manage an internal reporting channel, triage and investigate reports with integrity, interact correctly with Spain's Independent Authority for the Protection of Informants (Autoridad Independiente de Protección del Informante, A.A.I.), and respond lawfully when retaliatory conduct is alleged or detected. Real-world procedural guidance is anchored throughout to the specific articles of Law 2/2023.
Upon completion, managers and compliance teams will be able to fulfil their legal obligations, protect both informants and the organisation, and embed a culture of accountability that meets the expectations of Spanish regulators and the wider European whistleblowing framework established by EU Directive 2019/1937, which Law 2/2023 transposes into Spanish law.
