French Triage: Managing Secure Reporting Internal Channels

This course is the second in a two-part series developed for French organisations navigating their obligations under the Loi Sapin II (Law No. 2016-1691 of 9 December 2016) and the Loi Waserman (Law No. 2022-401 of 21 March 2022), which transposed the European Union Whistleblowing Directive (2019/1937) into French law. Designed specifically for managers and compliance professionals, it moves beyond awareness to equip participants with the operational knowledge required to run an effective, legally compliant internal reporting system — from first receipt of an alert through to closure and record-keeping.

Participants will explore how to triage incoming reports, assess their validity and urgency, assign appropriate investigators, manage conflicts of interest, and communicate with reporters in a manner that preserves confidentiality and encourages further engagement. The course addresses the critical obligations imposed by the Waserman Law, including mandatory acknowledgement timelines, feedback to reporters, the prohibition on retaliation, and the expanded definition of protected persons, as enforced by the Défenseur des droits and, where relevant, the Autorité des marchés financiers (AMF) and the Agence française anticorruption (AFA).

By the end of this course, managers and compliance teams will be able to distinguish protected disclosures from other complaints, apply a structured triage methodology, avoid common procedural errors that expose organisations to regulatory sanction, and build a reporting culture grounded in trust and legal certainty. This course should be taken in conjunction with its companion module aimed at all staff members.
